1. Introduction

This Terms of Use Agreement ("Agreement") is entered into by and between BluCast Streaming-TV ("BluCast") and the Client ("Client"). By subscribing to BluCast's prepaid monthly streaming television service, the Client agrees to be bound by the terms and conditions of this Agreement. This Agreement shall be governed by the laws of the Kingdom of Lesotho, which shall have exclusive jurisdiction over any disputes arising from or related to this Agreement.

2. Service Delivery

2.1. Subscription: BluCast provides a prepaid streaming television service, which the Client subscribes to on a monthly basis. The Client agrees to pay the subscription fee upfront each month. The subscription fee is non-refundable, except as otherwise provided herein or required by law.

2.2. Service Activation: Upon receipt of the monthly subscription fee, BluCast will activate the Client’s access to the streaming service. Activation typically occurs within 4 hours of payment confirmation.

2.3. Service Scope: The streaming service includes access to a selection of television channels and on-demand content as specified on BluCast’s website. BluCast reserves the right to modify the content offerings at any time without prior notice.

2.4. Service Availability: BluCast will use reasonable efforts to ensure the streaming service is available 24/7. However, service availability may be subject to interruptions due to maintenance, updates, or technical issues. BluCast shall not be liable for any interruptions in service.

3. Service Features

3.1. Channel and Content Access: The Client will have access to a variety of television channels and on-demand content as outlined on the BluCast website. The available content may change periodically, and BluCast reserves the right to update its content offerings without prior notice.

3.2. Quality of Service: BluCast aims to provide high-quality streaming services. However, the quality and availability of the streaming service may be affected by factors outside BluCast’s control, including the Client’s internet connection.

3.3. Device Compatibility: The streaming service is compatible with a range of devices as specified on the BluCast website. The Client is responsible for ensuring their device meets the necessary requirements to access the service.

4. Payment Terms

4.1. Subscription Fee: The Client agrees to pay the monthly subscription fee in full prior to the start of each subscription period. The fee amount is specified on BluCast’s website and is subject to change with prior notice to the Client.

4.2. Payment Method: Payments must be made using the methods accepted by BluCast, which may include credit/debit card, bank transfer, or other electronic payment systems.

4.3. Late Payments: Failure to pay the subscription fee on time may result in suspension or termination of the Client’s access to the service. BluCast reserves the right to charge a late fee for overdue payments.

5. Professional Ethics and Privacy

5.1. International Professional Ethics: BluCast commits to providing its services in accordance with international professional ethics standards. This includes delivering high-quality content, ensuring fair business practices, and respecting the rights of all stakeholders.

5.2. Privacy Policy: BluCast is committed to protecting the Client’s privacy. The collection, use, and disclosure of personal information will be governed by BluCast’s Privacy Policy, which is available on BluCast’s website. By agreeing to these terms, the Client consents to the processing of their personal data in accordance with the Privacy Policy.

6. Term and Termination

6.1. Term: This Agreement is effective from the date the Client subscribes to the service and continues on a month-to-month basis until terminated by either party in accordance with the terms herein.

6.2. Termination by Client: The Client may terminate their subscription at any time by providing written notice to BluCast. Termination will be effective at the end of the current subscription period.

6.3. Termination by BluCast: BluCast reserves the right to terminate this Agreement and suspend the Client’s access to the service immediately and without notice if the Client breaches any term of this Agreement.

7. Limitation of Liability

BluCast shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the streaming service, even if BluCast has been advised of the possibility of such damages. BluCast’s total liability to the Client for any claim arising under this Agreement shall not exceed the amount paid by the Client for the subscription fee in the three months preceding the claim.

8. Miscellaneous

8.1. Amendments: BluCast reserves the right to amend this Agreement at any time. Any amendments will be effective upon posting the updated Agreement on BluCast’s website. The Client’s continued use of the service constitutes acceptance of the amended terms.

8.2. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the Kingdom of Lesotho. The courts of Lesotho shall have exclusive jurisdiction over any disputes arising out of or in connection with this Agreement.

8.3. Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8.4. Entire Agreement: This Agreement constitutes the entire agreement between BluCast and the Client regarding the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral.

IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the date the Client subscribes to the service.
